I am a disabled individual,being evicted from a Section 8 Housing assistance program. I have a landlord, that is having me evicted, for my  complaints about the laundry facilities being vented thru my apartment.I have reported the landlord and to the  City Inspectors Dept ,he refuses to vent properly and I have severe asthma.He further informs me my entire apartment needs to be dregged out to install new venting which is a lie, a dryer is vented to the out side of a building, not thru a living residence.My parents have offered a peice of land on their farm to place a mobile home,I can not afford this and neither can they,I was wondering if their are grants for Disabled ppl. to move to a rural area or assistance in helping me receive a grant to purchase a mobile home? I have many physical disabilities and will require help in taking care of myself, which if I could move to my families, small acreage,they can help care for me,but they are not in a financial situation to provide me with a place to live on that acreage. All this too depends on if the zoning board will approve a varience to place a mobile home on,which could take up to 2~3 months to be approved. Is there anyone who could advise me on some assistance? I am not looking for a hand out just a decent place to live before the pollution that I have endured for 2 and one half years now degrades my health even further.Thank -You Very Much. Dawn Gayle. Here is some information for you. And if you are low income, and have a disability you have access to FREE legal aid. I would fight this. The laws are FOR the disabled. If you get evicted, you will lose your section 8 for FIVE years and not be able to do anything about it. You will then have to reapply. GET help....FIGHT this! 

Protection if You Have a Disability

If you or someone associated with you:

  • Have a physical or mental disability (including hearing, mobility and visual impairments, chronic alcoholism, chronic mental illness, AIDS, AIDS Related Complex and mental retardation) that substantially limits one or more major life activities
  • Have a record of such a disability or
  • Are regarded as having such a disability

your landlord may not:

  • Refuse to let you make reasonable modifications to your dwelling or common use areas, at your expense, if necessary for the disabled person to use the housing. (Where reasonable, the landlord may permit changes only if you agree to restore the property to its original condition when you move.)
  • Refuse to make reasonable accommodations in rules, policies, practices or services if necessary for the disabled person to use the housing.

Example: A building with a "no pets" policy must allow a visually impaired tenant to keep a guide dog.

Example: An apartment complex that offers tenants ample, unassigned parking must honor a request from a mobility-impaired tenant for a reserved space near her apartment if necessary to assure that she can have access to her apartment.

However, housing need not be made available to a person who is a direct threat to the health or safety of others or who currently uses illegal drugs.

Hi Dawn, I am sure that it is not lawful for a landlord to evict you because you complained about an unsafe condition. I think that if you get hold of the HUD people who administer Sec. 8 you will find that the landlord must have good reason to evict you. I believe that man is correct when he says that the landlord has to provide you with alternative housing if you are unable to stay in your apt. while work is being done on it. I would ask HUD for a booklet on landlord/tenant law, they probably have one. The system is a mess and a mess to deal with. See my aidpage and you will understand that I have problems with this bureaucratic crap also. You know, I am pretty sure that most Sec. 8 vouchers can be moved to a different locale if you ask them to do so. Good luck to you. Take Care and God Bless you. Stephanie.

good morning/afternoon im a leasing consultant from maryland and i do not know all the laws for landlord and tenats in chicago but your landlord can't evict you if your disable and he plan on doing contracting work that will disturb your living arrangements. he needs to provide you with an alternative housing before he can do such contracting expecally if you have a lease. you should contact a local apartment complex and ask for a landlord tenat (lol i can't spell that word) handbook and find out the rules and regulation.

Thank U so much Brighan! I have recently went before my counties zoning board, to place a mobile home on my families farm acreage. They also denied me and my family to do this. What makes it so frustrating is that I was told this would be precedent setting action and that no single wide mobile homes have been issued a permit, in my county since 1994,which is a out right lie.I have the written proof of it.My families farm acreage,joins a hauling business and they have no less than 8 single wides setting there!!!!Plus a few DBL. wides also.We are trying to appeal to my districts Congressional Represenitive at the moment. I have been discriminated against and lied to by a County Board that we elected.Seems like a person that is disabled or in poverty stands no chance against: "THE SYSTEM". I am sorry that you are being evicted. However, the laws of your state may be different than Minnesota for housing law. Most lawyers have initial contact visits FREE of charge and your County Human servicews should be able to help you if you are already receiving Section 8 benefits. Contact your neighborhood planning Council for contact information to the resources provided in your area. Good luck!
